Unfortunately, the airline did not respond. As a result, we had to issue court proceedings and ask the court to enter Judgment against the airline. Review of your file shows that your claim was settled within 5 months of instruction which is within the average timeframe of a low-value personal injury claim. Unfortunately, due to the introduction of the Civil Liability Act 2018 that came into effect May 2021 we are unable to recover costs from the Defendant Insurers for dealing with your claim, therefore, deductions are applied to your compensation. You were compensated inline with the tariff system that was introduced as a part of the Civil Liability Act mentioned above. We appreciate that the settlement amount may be less than you were expecting. However, we are unable to dispute and/or negotiate settlement that is subject to the tariff system, like your claim was.
