I can see that our physiotherapy provider was unable to make contact with you following the instruction and so closed their file down. In terms of the medical assessment we are sorry to hear that you found the process frustrating. The medical assessment is arranged and handled through a third party and not directly by Bott and Co. In terms of having the appointment arranged through Zoom, this is a choice and is something that was brought into practice following the COVID outbreak. We understand that for some people this is not always ideal and as you say is strange and is why you have the choice to attend a face to face appointment should you prefer.
Unfortunately, your case was directly affected by the Government reforms known as the Civil Liability Act, in relation to whiplash injuries, that came into force on 31st May 2021. This change meant that the Government reduced the amounts Claimants could recover for whiplash injuries and essentially introduced a tariff-based injury system based on injury length, which is fixed within the law. In some cases, this has resulted in Claimants now receiving between 80% – 90% less than they did before these legal reforms were introduced, with certain fixed amounts payable based on your injury length.
We fully appreciate that the new Government tariffs provide for low awards and the introduction of this new scheme was something that we campaigned heavily against. Unfortunately, the tariffs for whiplash injuries are now fixed within law and there is no scope to recover more than these fixed tariff amounts.
