Thanks for taking the time to leave your comments. I can see that our physiotherapy provider was unable to make contact with you following the instruction and so closed their file down. In terms of the medical assessment we are sorry to hear that you found the process frustrating. The medical assessment is arranged and handled through a third party and not directly by Bott and Co. In terms of having the appointment arranged through Zoom, this is a choice and is something that was brought into practice following the COVID outbreak. We understand that for some people this is not always ideal and as you say is strange and is why you have the choice to attend a face to face appointment should you prefer. Unfortunately, your case was directly affected by the Government reforms known as the Civil Liability Act, in relation to whiplash injuries, that came into force on 31st May 2021. This change meant that the Government reduced the amounts Claimants could recover for whiplash injuries and essentially introduced a tariff-based injury system based on injury length, which is fixed within the law. In some cases, this has resulted in Claimants now receiving between 80% – 90% less than they did before these legal reforms were introduced, with certain fixed amounts payable based on your injury length. We fully appreciate that the new Government tariffs provide for low awards and the introduction of this new scheme was something that we campaigned heavily against. Unfortunately, the tariffs for whiplash injuries are now fixed within law and there is no scope to recover more than these fixed tariff amounts. We always strive to provide the highest level of service and update our clients at each key stage. We corresponded with you via email to update you at the various milestones as your case progressed through the Official Injury Claims Portal. Unfortunately, your case was directly affected by the Government reforms known as the Civil Liability Act, in relation to whiplash injuries, that came into force on 31st May 2021. This new set of rules reduced the amount that could be claimed for whiplash and provides insurers with a considerable period of time to consider your claim and respond. The response times at each stage were confirmed in the letters we sent out. We do appreciate the response times afforded to insurers are lengthy and our often weighted in the insurers favour. Unfortunately, this does result in periods where we are waiting for the Defendant insurer to respond before we can progress your claim. In terms of your insurance premium this is not something we have control over. As liability was admitted for your accident and you were found not to be at fault then your insurance policy should not materially increase as a result of your personal injury claim. We can assure you we would never ignore a clients claim and can confirm your case was progressed in line with all expected timeframes with relevant updated provided at each key stage as your case progressed through the Official Injury Claims Portal. Unfortunately, your case was directly affected by the Government reforms known as the Civil Liability Act, in relation to whiplash injuries, that came into force on 31st May 2021. This new set of rules provides insurers with a considerable period to review your claim and respond. The response times at each stage were confirmed in the letters we sent out. Your case was concluded in just over 5 months which is a reasonably quick turnaround time accounting for the response times afforded to the insurer at each stage of the claims process. Unfortunately, this does result in periods where we are waiting for the Defendant insurer to respond before we can progress your claim. In addition, we are unable to request an offer from the Defendant insurer until all losses have been finalised and all physiotherapy has been completed. This can unfortunately, prolong certain cases whilst physiotherapy treatment is completed, and all relevant evidence is obtained.
